وذلك من خلا : قانون تفاضل المصالح والأضرار
1- إذا كان لدي ّ خيار بين أمرين كلاهما مصلحة: أختار الأمر ذو المصلحة الأعظم (تفضيل أعظم المصلحتين).
2- إذا كان لدي أمرين لا خيار ثالث لهما وكلاهما ضرر: أختار الضرر الأقل ولي أجر في فعله؛ لأنني دفعت بالضرر الأصغر ضرراً أكبر.
3- إذا كانت المصالح والأضرار غير واضحة ومختلف عليها: عندها نستعمل قانون (درء المفاسد مقدم على جلب المصالح).
